General terms and conditions of Kletterwald Stadion Frankfurt GmbH

  • 1 Scope of the General Terms and Conditions

(1) Kletterwald Stadion Frankfurt GmbH, located at Herz von Europa 1, 60528 Frankfurt (hereinafter referred to as the “Operator”), operates the climbing forest at Deutsche Bank Park, Mörfelder Landstraße 362, 60528 Frankfurt (hereinafter referred to as the “Climbing Forest”). The following General Terms and Conditions, in the version valid at the time of use, apply to the use of the climbing forest by the user.

(2) In principle, every user who wishes to use the climbing forest must submit a declaration of consent in advance and confirm that they have read and agree to the General Terms and Conditions. The declaration of consent can only be submitted digitally. If the user does not have a mobile device, they can submit the declaration of consent on site on one of the operator's devices.

The legal guardian or supervisor of a user under the age of 18 acknowledges the General Terms and Conditions for the user and confirms that the General Terms and Conditions have been discussed with the minor user before using the operator's services.

  • 2 Right of use

(1) Use of the climbing forest is subject to a fee.

(2) The prices for use are based on the currently valid price list and refer to the specified duration of use of the facilities (“climbing time”).

(3) The “climbing time” consists of approximately 30 minutes of safety instruction and 2 hours in the climbing forest. The equipment must be returned after 150 minutes. Use begins with the instruction.

(4) Children aged four and above are allowed to climb on the children's course. Children under the age of six must be supervised by an adult (from the ground) on the children's course. From the age of six, children are also allowed to climb on high courses (from a height of 2.5 m) with the appropriate age rating. Children under the age of 12 must be accompanied by an adult on the high courses. Children aged 6-9 and children who do not have the required reach height of 165 cm must be accompanied by an adult who climbs with them through the course. One adult can supervise up to 2 children. From the age of 10 and with a reach height of at least 1.65 m, supervision from the ground is also possible, with one adult able to supervise up to 6 children.

(5) Children under the age of 12 may only use the climbing garden under the supervision of a parent or guardian or another adult authorized to supervise them.

(6) Young people aged 12 and over may only use the climbing forest without being accompanied by a parent or guardian upon presentation of a corresponding declaration of consent from their parents or guardians. This declaration of consent can only be submitted digitally, either on the website or on site on one of the operator's devices.

(7) Groups of underage users must be accompanied by an adult group leader who is authorized to supervise them. It is the responsibility of the adult group leader to obtain the declaration of consent from all legal guardians of the underage group members before using the climbing forest.

(8) Persons weighing more than 120 kg may not use the facilities.

  • 3 Liability

(1) The use of the operator’s facilities and premises involves risks and is undertaken at the user’s own risk and responsibility.

(2) Climbing is considered a high-risk sport and therefore requires a high degree of caution and personal responsibility. The scope of this responsibility is particularly defined by § 4, which every user must observe.

(3) Every user must show the utmost consideration for other users and refrain from any behavior that could pose a risk to themselves or others. Users must be aware that they may be endangered by other users or falling objects and must take appropriate precautions on their own responsibility.

(4) The operator shall not be liable for damages resulting from climbing in the climbing forest or otherwise arising in connection with the stay in the climbing forest. This does not apply to claims arising from the breach of essential contractual obligations (including safety obligations) and/or in cases of intentional or grossly negligent conduct by the operator (including their agents and vicarious agents). Under no circumstances shall the operator be liable for unforeseeable or indirect damages. Liability for culpable injury to life, body, or health remains unaffected.

(5) Any damage must be reported to staff immediately and before leaving the climbing forest.

(6) Parents and guardians are liable for their children or the persons entrusted to their care. Children are exposed to particular risks while in the climbing forest and especially while climbing, for which parents or guardians must take appropriate precautions on their own responsibility. Children must be supervised at all times during their stay in the climbing forest.

In groups consisting of multiple minors or school classes, adult group leaders are responsible for ensuring that all members of the group comply fully with the operator’s general terms and conditions.

(7) Users are responsible for their personal belongings. No liability will be assumed for loss or theft.

  • 4 Safety Instructions and Equipment

(1) Every user must attend a safety briefing before entering the climbing forest.

(2) Before entering the course, users must complete the training course under the supervision of a climbing forest staff member.

(3) Users who are unable to correctly apply the prescribed safety rules for self-protection must refrain from participating in the climbing forest.

(4) Users must never be unsecured while on the course. At all times, two carabiners (smart belays) must be attached to the safety cable. When switching from one cable to another, one carabiner must always remain connected. If the course uses a continuous safety system (e.g. children's course), the user must clip in at the beginning and remain connected throughout. In case of any uncertainty or doubt about proper use, a staff member must be called immediately.

(5) Each station may only be used by one person at a time. A maximum of three persons may occupy a platform at any one time. This rule does not apply to the partner course.

(6) Zip lines must be used in a controlled manner. Jumping into the zip line is not permitted. Braking is required on zip lines to avoid strong impact at the landing point. Zip lines may only be used when it is certain that no one is in the landing area or still on the line. The zip line cable must be clear.

(7) All instructions and decisions made by the operator and/or staff are binding. In case of violations or non-compliance, users may be excluded from the climbing forest without a refund of the entry fee. The operator assumes no liability for damages resulting from such violations.

(8) The rented equipment (helmet, harness, safety lanyard with carabiners) must be worn and used according to the instructions of the operator and/or their staff, and in accordance with the safety briefing. It is non-transferable, must not be removed during use of the climbing forest, and must be returned within three hours of issue. Any damage to the equipment must be reported to staff immediately. Personal equipment may not be used.

(9) Areas marked as closed must not be entered or climbed. To protect the forest floor and for personal safety, users must stay on marked paths.

(10) No objects may be carried during the course that could pose a risk to the user or other persons on the ground. This includes, in particular, jewelry, bags, water bottles, backpacks, mobile phones, and cameras.

(11) Users must wear appropriate clothing and sturdy footwear. Long hair must be tied back to prevent injury.

  • 5 Prohibition of Climbing Under the Influence of Intoxicating Substances

(1) The use of the climbing forest facilities is prohibited for persons under the influence of alcohol, drugs, or any other intoxicating substances.

(2) The operator is entitled to exclude participants from use if such influence is suspected or detected.

(3) In such cases, there is no entitlement to a refund or reduction of the fee already paid.

(4) The operator reserves the right to exercise their domiciliary rights if participants violate this prohibition.

  • 6 Copyright

(1) The operator reserves the right to take photo, video, and webcam recordings throughout the climbing forest during use and to use these for advertising and informational purposes. Users who do not agree to this must notify the staff before using the facilities.

(2) Photo, video, and webcam recordings for purposes other than private use may only be made with prior approval from the operator.

  • 7 Domiciliary Rights

(1) The operator or persons acting on their behalf reserve the right to exclude individuals from using the climbing forest if they do not comply with these General Terms and Conditions.

(2) The operator exercises domiciliary rights and reserves the right to suspend operations at any time for safety reasons or due to adverse weather conditions (fire, storms, lightning, technical defects, accidents, etc.), either partially or completely. In such cases, no refund of the entrance fee will be given.

(3) The climbing forest, as part of nature, must be kept clean and treated with care. Waste must be disposed of in the provided bins.

(4) Dogs must be kept on a leash at all times on the premises of the climbing forest.

(5) Smoking is strictly prohibited while wearing climbing equipment and throughout the forest.

(6) By entering the spatial scope of the stadium regulations, users and visitors of Deutsche Bank Park acknowledge the validity of the privately regulated stadium rules of Deutsche Bank Park.

  • 8 Data Protection

(1) The operator collects only the data necessary to operate the facility at a safety-relevant level. This particularly includes the signed acknowledgment of the General Terms and Conditions.

(2) The operator does not disclose personal data to third parties unless the user has given explicit consent.

 

  • 9 Severability Clause

(1) If any part or all of these General Terms and Conditions are not included in the contract or are deemed invalid, the remainder of the contract shall remain in effect.

(2) To the extent that provisions are not part of the contract or are invalid, the content of the contract shall be governed by statutory provisions.
